May 9th, 2017 is an important milestone in the conduct of the October election of Liberia as the National Election Commission will be issuing “Writ of Election” the official commencement of the opening of the election to be followed by the “Exhibition Period” on June 12th-June 17th which must be sealed under the signature of the Chairman of the National Election Commission but the current Chairman, Cllr Jerome Korkoyah is embattled and found to be a United States citizen with media outlets publishing his United States passport, U S naturalization number and date and place of his naturalization as well as his voting records from the U S 2008 election showing he is an active registered voter and voted in 2008 in Williamsboro, New Jersey but also registered voter in three other states including New York, Louisianan and Kentucky proven in stone he is citizen of the United States.
Despite the ocean of evidence Chairman Korkoya is a United States citizen and outrage calling he steps down or the President removes him, the refusal of President Sirleaf to remove the Chairman who by law is a foreigner because Liberia does not have dual citizenship, the President is in violation the constitution, gross misconduct and endangering the peace and security of the Republic and therefore for their safety, the Liberian citizens should invoke articles 1 and 62 and collect 10,000 signatures for impeachment and submit it to the House of Representatives which will automatically trigger the impeachment to impeach President Ellen Johnson-Sirleaf refusing to remove the Chairman enabling and protecting him to violate the constitution, election laws which stipulate Commissioners and the Chairman must be a Liberian with good moral character. Below are the articles which stand as the constitutional basis to impeach the President.
All power is inherent in the people. All free governments are instituted by their authority and for their benefit and they have the right to alter and reform the same when their safety and happiness so require. In order to ensure democratic government which responds to the wishes of the governed, the people shall have the right at such period, and in such manner as provided for under this Constitution, to cause their public servants to leave office and to fill vacancies by regular elections and appointments
The President and the Vice–President may be removed fro office by impeachment for treason, bribery and other felonies, violation of the Constitution or gross misconduct.
The Liberian government’s response to these revelations about the foreign citizenship of Chairman Korkoya that the government is not aware of the Chairman being a U S citizen, is appalling because it is the government negligence and should bear full responsibility for appointing a U S citizen to preside over Liberia’s elections because the government did not do due diligence by vetting Cllr Korkoya but took on face-value what he told them including the Legislature who he lied to under oath, a felony, that he was not a foreign citizen during his confirmation.
President Sirleaf if tampering with the peace and security of Liberia by blatantly refusing to remove Chairman Korkoya despite overwhelming evidence proving he is a United States citizen and can not preside over the sovereign election of the country, putting the country in danger as his continuous stay at the Commission, presiding over the election has the potential of creating chaos and pushing the country on the brink of instability, ignoring how elections are normally full of tensions and for this Liberia’s election, a constitutional and legal headache will accord the election if Chairman Korkoya remains because any thing or administrative work or action he takes as of the revelation of his United States citizen will be null and void because he is a foreigner by Liberian laws including the election laws and can not preside over the election.
May 9th is the official beginning of the October election as the Commission will be issuing the “Writ of Election”, a very serious responsibility the Commission must conduct, followed by the Exhibition Period at which time ineligible voters could be challenged including those with foreign citizenship but registered during the voter registration and hearing will be conducted by the Commission which also entangle the Chairman in conflict of interest, the very crust of the Code of Conduct he swore to protect and enforced before his foreign citizenship was exposed.
Political parties, candidates and the public could challenge Chairman Korkoya on anything he does at the Commission from the very moment he was exposed because as of that moment, he is an illegitimate chairman and anything he does is null and void and for that , President Sirleaf is willfully pushing the country over the cliff of constitutional and legal crisis, jeopardizing the peace and security of the Republic and as such, citizens will have no option but to impeach President Sirleaf.
Several aspirants are either foreign citizens and others in violation of the Code of Conduct and would eventually be challenged and the Commission will conduct a hearing to determine their eligibility but how impartial and legal standing will the Commission have when himself is a foreign citizen.
Liberia is headed for trouble if the citizens lay back and enable the President derelict her primary responsibility, to protect the country in pawn of non Liberian presiding over a sovereign country election whose outcome will ultimately be challenged at the Supreme Court once a candidate or political party finds the election result unfavorable to them and chaos could engulf the country.
A group, the National Democratic Caolition-NDC last week announced they will take Chairman Korkya to Supreme Court to ask for his removal because he is a United States citizen and by Liberian law is a foreigner and can not preside over the country election.
Chairman Korkoyah denies the allegation and the material evidence.
